These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and SomnaX ("we", "us", "our") governing your use of the SomnaX mobile application ("App") and any related services. By creating an account or using the App, you confirm that:
SomnaX is a general wellness and breathing application that provides:
The App is available in English, Turkish, Spanish, German, French, Italian, and Simplified Chinese.

SomnaX uses Apple's Sign in with Apple to authenticate users. You must have a valid Apple ID to create an account. By signing in, you agree to comply with Apple's terms of service in addition to these Terms.
You are responsible for maintaining the confidentiality of your Apple ID credentials and for all activity that occurs under your account. Notify us immediately at support@somnax.app if you suspect unauthorized use of your account.
You may delete your account at any time through the Profile screen in the App. Deletion removes your personal data from our backend. Note that deleting the App from your device will also delete all locally stored data (session history, chat history, preferences) that has not been backed up.
The free tier of SomnaX includes access to core breathing modes, programs, and the AI companion with a daily message limit of 25 AI chat messages per day. Free-tier users may also see interstitial advertisements.

Payment is charged to your Apple ID account at confirmation of purchase. Pricing is subject to change; you will be notified before any price change affecting your active subscription.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription at any time in your Apple ID Account Settings or in the App Store Subscriptions page.
We may offer free trial periods for Premium. If a free trial is offered, you will not be charged during the trial period. Your subscription will begin and billing will start automatically at the end of the trial unless you cancel before the trial ends. Any unused portion of a free trial period is forfeited when a purchase is made.
Subscription payments are processed by Apple through the App Store. Refund requests must be directed to Apple in accordance with Apple's refund policy. We do not issue refunds directly for App Store purchases. To request a refund, visit reportaproblem.apple.com.

You agree to use SomnaX only for lawful purposes and in accordance with these Terms. You agree NOT to:
The App, including its design, code, content, AI system prompts, breathing programs, and all related materials, are owned by SomnaX and protected by copyright, trademark, and other intellectual property laws. Your use of the App does not grant you any ownership rights.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use on Apple devices you own or control, subject to these Terms and the Apple App Store Terms of Service.
When you use the AI chat feature, you may provide text input (including voice-transcribed text). By submitting content to the AI chat, you grant us a limited license to process that content solely to generate your requested response. You retain ownership of your inputs. We do not claim any ownership of your chat content.
You agree not to input into the AI chat any content that is illegal, harmful, or violates the rights of others. We reserve the right to take appropriate action if we receive valid legal requests or notice of abuse.
The App integrates with third-party services including Supabase (backend infrastructure), OpenAI (AI companion responses, with your in-app consent), Google AdMob (advertising for free users), and Apple (authentication, payments, speech recognition). Your use of these third-party services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.
Free-tier users may encounter interstitial advertisements displayed by Google AdMob. These ads are served by Google's ad network and are subject to Google's ad policies. We are not responsible for the content of third-party advertisements. Premium subscribers are not shown advertisements.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOMNAX AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $10.00, WHICHEVER IS GREATER.
BREATHING EXERCISES ARE GENERALLY SAFE, BUT INDIVIDUAL RESULTS VARY. SOME USERS MAY EXPERIENCE LIGHTHEADEDNESS, DIZZINESS, OR DISCOMFORT DURING BREATHING EXERCISES. STOP ANY EXERCISE THAT CAUSES DISCOMFORT. CONSULT A PHYSICIAN BEFORE STARTING ANY NEW WELLNESS ROUTINE, PARTICULARLY IF YOU HAVE A RESPIRATORY CONDITION, CARDIOVASCULAR DISEASE, EPILEPSY, OR ARE PREGNANT.
You agree to indemnify, defend, and hold harmless SomnaX and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the App.
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms, are engaging in fraudulent activity, or if required by law. Upon termination, your license to use the App ceases immediately. Sections 6, 7, 11, 12, 14, and 15 survive termination.
You may terminate your use of the App at any time by deleting the App and your account.
These Terms shall be governed by and construed in accordance with applicable laws. We encourage you to contact us first to resolve any dispute informally. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration or the courts of competent jurisdiction in the applicable territory, as required by local law.
Apple is not a party to these Terms and has no obligation whatsoever to provide maintenance or support for the App. To the extent these Terms conflict with the Apple App Store Terms of Service, the App Store Terms take precedence.
The following terms apply to your use of SomnaX as downloaded from the Apple App Store:
We may modify these Terms at any time. When we do, we will update the "Last updated" date. Material changes will be communicated through an in-app notice or notification. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and delete your account.
