Terms of Use
The rules for using PickPulse X, in plain language.
1. Acceptance
By downloading or using PickPulse X you agree to these terms. If you do not agree, please do not use the app.
2. What the app is
PickPulse X shows statistical forecasts for upcoming basketball games: chances, projected scores and ranges, with past forecasts shown next to final scores. Forecasts are estimates produced by statistical methods from past results and public information. The app is free to download and needs no account. Every day you can choose two upcoming games to see in full for free, and finished games of the last two days are shown with their forecast for free. Other forecasts and the team ratings can be unlocked with optional in-app purchases (section 4).
3. Analysis only, no guarantees
PickPulse X is statistical analysis, not advice of any kind. Forecasts can be wrong, games are unpredictable, and information such as injury reports can change at any time. We make no promise about the accuracy, completeness or timeliness of anything shown. Please do not rely on the app for any financial or other decision.
4. In-app purchases
- Game packs (5, 10, 50 or 100 games) add game unlocks to your account. Each unlock opens the full forecast of one upcoming game of your choice. Game unlocks never expire, and an unlocked game stays unlocked.
- Season Pass opens every game, past forecasts in the calendar and all team ratings until June 30, 2027. It is a one-time purchase and does not renew automatically.
- All purchases are one-time payments charged to your Apple Account by Apple. There are no subscriptions that renew. Prices are shown in the app before you buy.
- Purchases are linked to the anonymous App Store identifier of your Apple Account for this app, so they are available on your other devices with the same Apple Account and after reinstalling. Use "Restore purchases" in the app if something is missing.
- If a game you unlocked with a game unlock is cancelled, the unlock is returned to you. A game cannot be unlocked after it has started.
- Refunds are handled by Apple under its policies (reportaproblem.apple.com). If Apple refunds a purchase, what it gave is removed.
- Purchases unlock statistical analysis only. They are not a bet, a wager or a stake of any kind and have no cash value.
5. Acceptable use
- Use the app for your own personal purposes.
- Do not copy, scrape, resell or redistribute the app's forecasts or content at scale, and do not interfere with the service that delivers them.
- Do not reverse engineer the app except where the law allows it despite this restriction.
6. Intellectual property
The app, its design, text and forecasts belong to us. Team names appear only as city abbreviations and locations. PickPulse X is not affiliated with or endorsed by any league, team or player, and shows no logos. Fonts used in the app are licensed under the SIL Open Font License.
7. Availability and changes
We may update, change or discontinue features or the forecast service at any time; if we discontinue the forecast service, unused game unlocks and the remaining Season Pass period cannot be used, and we will give notice in the app where we can. The service depends on third-party infrastructure and public information, so occasional delays or gaps may occur.
8. Disclaimers and limitation of liability
The app is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the app or from reliance on any forecast.
9. Termination
You may stop using the app at any time by deleting it. We may suspend access if these terms are broken.
10. Governing law
These terms are governed by the laws applicable where we operate, without regard to conflict-of-law rules, except where local consumer law gives you stronger rights. We encourage you to contact us first to resolve any issue informally.
11. Apple-specific terms
- These terms are between you and PickPulse X, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your license is limited to use on Apple-branded products you own or control, as permitted by the App Store usage rules.
- We are solely responsible for any maintenance and support. Apple has no obligation to provide any.
- If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price; to the extent permitted by law Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability, legal or regulatory compliance and intellectual property claims.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12. Changes to these terms
We may update these terms. The date at the top shows the latest version; continued use means you accept the changes.
